| الملخص: إن علم أصول الفقه من خلال تقعيد قواعده مثّل منهجا مقصديا يبتغي توجيه ملكة الاجتهاد عند الباحثين في العلوم الشرعية، حيث أسس به العقل الإسلامي منهجا شرعيا قادرا على الاجتهاد لاستنباط الأحكام في جميع مجالات البناء الحضاري في الفكر الإسلامي، وبذلك تضمن هذا العلم فوائد هامة، لا يمكن الاستغناء عنها أو تقليل أهميتها. من هذا المنطلق فحديثنا عن أثر علم أصول الفقه في ترسيخ منهج الاجتهاد في الفكر الأصولي، يبتغي تحقيق المقاصد الآتية:تحديد مدى وفاء هذا العلم بغاياته، ومقاصده قديما وحديثا.استكشاف دور علم أصول الفقه في ترسيخ الوسطية في الفقه الإسلامي.لقد أوضحت هذه الدراسة الدور المنهجي لعلم أصول الفقه في إحياء منهج الاجتهاد، وقد تَوَسَّلتُ في ذلك بدراسة أصولية تحليلية، كما خلصت هذه الدراسة لأهمية المنهج الأصولي في الفقه الإسلامي . الكلمات المفتاحية: أصول الفقه، الاجتهاد، المنهج، الفكر الأصولي، تقعيد، القواعد، الوسطية، المقاصد، الفكر الإسلامي، منهج مقصدي، البناء الحضاري، أثر العلم، الفقه الإسلامي، إحياء منهج الاجتهاد، دراسة أصولية تحليلية، استكشاف دور علم الأصول، الدور المنهجي، أهمية المنهج الأصولي، وفاء العلم بغاياته، تأسيس العقل، العقل الإسلامي، المقاصد قديما وحديثا. |
| Abstract: The science of Usul Al fiqh through its formation rules represented a purposeful methodology that seeks to direct the ijtihad skill for researchers in the Islamic legitimace where the Islamic mind established a legitimate philosophical approach that capable of ijtihad to derive rulings in all areas of civilized construction in Islamic thought. Thu, this science contained important benefits, irreplaceable or underestimated. From this standpoint, our talk about the effect of Usul Al fiqh on the formation of ijtihad skill in Jurisprudential thought aims to achieve the following goals:• to Determine the extent to which this science fulfills its goals, and its purposes, in past and present.• to explore The Role of Usul Al fiqh in reinforcing moderation in jurisprudence Islamic. This study has illustrated The Role of Usul Al fiqh in reinforcing methodology of Ijtihad and to do that the researcher uses a study on the fundamentalist analytical.
